2. APPLICABILITY

These sales conditions apply to all sales contracts concluded between Steel Bikes Stevens and the customer through the web shop, in the store or at a trade fair. Deviations from these general terms and conditions of sale can only be made by a written document signed by Steel Bikes Stevens and the customer. These general sales conditions completely exclude all general conditions mentioned in documents from the customer even if these documents are more recent. Steel Bikes Stevens reserves the right to modify and/or supplement the general terms and conditions at any time for future orders without personally informing the customer and without the latter being able to claim any compensation.

Placing an order on https://steelbikesstevens.be/ implies that the buyer agrees to these terms and conditions.

All images, photos, descriptions, … or data concerning weights, dimensions, colors, …. on the Steel Bikes Stevens web shop are only approximate, indicative and cannot give rise to compensation or dissolution of the agreement.

This website is the intellectual property of Steel Bikes Stevens. Nothing may be copied or used without permission from Steel Bikes Stevens.

3. THE ORDER

To purchase a product, the customer adds the product to the shopping cart. Then the customer fills in the contact and billing information. Subsequently the customer chooses the delivery and payment method. Finally, the customer accepts the terms and conditions and confirms.

4. RIGHT OF WITHDRAWAL

Within the European Union, when purchasing consumer goods, the customer has 14 days to decide not to keep the goods. This 14-day period starts on delivery.
The customer must return the goods within 14 days of giving prior notice of his/her wish to withdraw from the contract.

The customer shall inform Steel Bikes Stevens of his/her decision to withdraw from the contract by notifying Steel Bikes Stevens in writing by letter (Luipegem 74 2880 Bornem) or e-mail (info@steelbikes.be).

The customer may return the goods via courier of his/her choice or return them to the shop/depot located at Luipegem 74, 2880 Bornem. The cost of returning the goods shall be borne by the customer.

The purchase price, exclusive initial (standard) delivery costs, will be refunded within 14 days after the goods have been returned. If the customer has opted for insured delivery, these costs will also not be refunded. If the customer pays with PayPal and a transaction fee was due, this transaction fee will also not be refunded.

Reimbursement will be made to an account number to be specified by the customer.

The purchased goods must be returned complete, undamaged and in their original packaging at the customer’s own risk and expense. The products must always be returned with the original labels.

Steel Bikes Stevens his acceptance of the unopened package upon delivery by a shipping company does not imply any acceptance of the goods. Steel Bikes Stevens reserves the right to refuse the goods upon receipt if the goods are not in their original condition, or if Steel Bikes Stevens was not notified in a timely manner and/or the goods were not shipped in a timely manner. Delays in transport for any reason whatsoever are the sole responsibility of the customer and do not extend the acceptance period.

5. PRICES

All sales prices quoted are in euros, including VAT.
Delivery is subject to the special regime of taxation of the profit margin. VAT is not deductible.
Shipping costs are not included in the sale price. They are calculated at the end of the order.

6. PAYMENT

Steel Bikes Stevens offers multiple options to pay for an item:

IBAN bank transfer
This is the easiest and (in most cases) feeless option, straight into the bank account of Steel Bikes Stevens. Once the payment has been received, Steel Bikes Stevens will process the order.

Online check out with Credit Card, Debit Card, PayPal or local Payment processing system depending on the country the client lives.

Pick up and pay cash
The shop is only open on appointment. The client can pick up his/her order after making an appointment. This option will as well be chosen by the client when he/she wants to pick up goods at a bike show/trade fair.

Arrange payment
If the client wishes to trade items, please consult Steel Bikes Stevens first. Steel Bikes Stevens is open for all kinds of offers. When a deal is made, the items should arrive with Steel Bikes Stevens first for inspection and afterwards Steel Bikes Stevens will ship the items to you. All trades are final.

To ensure secure online payment and security of personal data, Steel Bikes Stevens uses SSL technology. SSL ensures that transaction data is encrypted and rendered unreadable when transmitted over the Internet. To pay with SSL, you do not need any special software. You can recognize a secure SSL connection by the lock symbol in the lower status bar of your browser.

7. LAYAWAY/PAYMENT PLAN/RESERVATION

Steel Bikes Stevens understands some items are expensive and cannot be fully paid once. Therefore it is possible to pay off an item. If the client wishes to use this option, he/she needs to consult Steel Bikes Stevens first before ordering the item in the online shop.
Steel Bikes Stevens will ask for a 20% non-refundable deposit from the start.
An installment plan should never exceed 90 days.
If the customer fails to honor the installment plan, Steel Bikes Stevens has the right to offer the item for sale again and withhold the 20% deposit

8. DELIVERY

Steel Bikes Stevens delivers worldwide, except in the countries of Russia, Ukraine and Indonesia because of import issues.
Unless otherwise notified, all goods are shipped within 1 working week of receipt of payment, unless otherwise agreed or notified.

All goods are properly packed and delivered to the address indicated by the customer at the time of ordering.

The exact rates of the shipping cost will be visible per country during the check-out.

Shipments are always made at the customer’s risk. The delivery shall therefore be made FCA (2880 Bornem)

Steel Bikes Stevens is not responsible for any consequential damages due to late delivery or non-delivery by the carrier. At the time of delivery, where applicable, the customer must sign off the delivery receipt for receipt. Any visible defects must be noted on the delivery note or reported in writing to Steel Bikes Stevens at the latest within a period of three working days, with the customer describing the defects in detail. The use of the goods by the customer implies their irrevocable acceptance.

9. RETENTION OF TITLE

The Goods remain the property of Steel Bikes Stevens until full payment of the price, including all costs and charges. In the event of non-payment, Steel Bikes Stevens reserves the right to take back the goods, ipso jure and at the buyer’s expense.

10. CONFORMITY

Steel Bikes Stevens guarantees that the goods conform to the photographs and descriptions as provided in the web shop and therefore meet the normal expectations one may have of 'vintage items’ considering the specifications of the product.

11. LIABILITY

Except in the event of fraud, intentional fault or gross negligence, Steel Bikes Stevens shall not be liable for or obliged to compensate any immaterial, indirect or consequential damage, including (but not limited to) loss of profit, loss of turnover, loss of income, production restrictions, administrative or personnel costs, an increase in general costs, loss of customers or claims from third parties.

12. PERSONAL DATA

By ordering on the Steel Bikes Stevens website, the buyer expressly authorizes the processing and use of his/her personal data for purposes such as administration of the customer database, management of orders, deliveries, payments, marketing and advertising.

Steel Bikes Stevens will always manage your personal data appropriately. Steel Bikes Stevens uses only those data necessary to provide an optimal service. Under no circumstances personal data will be provided to third parties.

13. FORCE MAJEURE

Steel Bikes Stevens is not liable if and as far as commitments cannot be fulfilled as a result of force majeure. By force majeure is meant any external cause, as well as any circumstance beyond its control. Without striving for exhaustiveness, all cases are considered as cases of force majeure: Delays of all kinds, Internet failures, electricity failures, e-mail traffic failures and failures or changes in technology supplied by third parties, transport difficulties, strikes, government measures, delays in supply, negligence on the part of suppliers of Steel Bikes Stevens as well as auxiliaries, illness of personnel, defects in auxiliary or transport means, war, natural disasters, fire, epidemic, lockdown,…

In the event of force majeure, the obligations of the party concerned shall be suspended. In such case, the parties shall make all reasonable efforts to limit the effects of a force majeure situation. In case the force majeure should last longer than 2 months, the other party shall be entitled to terminate the contract without court intervention, without the party invoking force majeure being liable to pay any compensation to the other party.

14. INTELLECTUAL PROPERTY

The website, logos, texts, photographs, names and all communications in general, are protected by intellectual property rights belonging to Steel Bikes Stevens.

It is prohibited to use and/or modify the intellectual property rights described in this article.

For example, one may not copy or reproduce drawings, photographs, names, texts, logos, color combination, etc. … may not copy or reproduce without prior and express written consent.

15. COMPLAINTS AND DISPUTES

All agreements, regardless of the place of residence of the customer, are governed exclusively by Belgian law. If for reasons of international law, a different law is applicable, the interpretation of these general terms and conditions will primarily refer to the Belgian Market Practices and Consumer Protection Act as included in the Code of Economic Law (Book VI).

In case of disputes, only the courts of the judicial district Antwerp, Belgium are competent.

16. DIVISIBILITY

If any article of these terms and conditions is considered null and void, this invalidity shall not affect the validity of the remaining articles. We reserve the right to replace this part.

If any part of these general conditions has been considered being too broad, the provision shall be enforceable to the maximum extent permitted by law.
All agreements between Steel Bikes Stevens and its customers are exclusively governed by Belgian law. The application of international treaties, including the Vienna Sales Convention, is expressly excluded.
Unless otherwise stated in mandatory law, all the disputes between the parties are subject to the exclusive jurisdiction of the courts of the area where the Steel Bikes Stevens offices are registered.
